Payment Method:
We accept VISA, MasterCard, Discover and American Express as well as Company Check, Registered Bank Certified Check and Wire Transfers. Your credit card will be charged for gifts ordered, then shipped or delivered in a reasonable amount of time. Credit card orders shipped to locations other than your billing address may require additional verification or delay in shipment. Make business and registered certified checks payable to Out of the Blue Delivered. Out of the Blue Delivered, inc. (OOTBD) reserves the right to add applicable taxes on shipments to foreign countries, as well as billing “recipient’s taxes and duties” upon customs clearance and acceptance of delivery.

Shipping, Handling and Processing Charges:
We ship by FedEx® for U.S. Territories, Canada and other International locations. For APO and FPO addresses, we use U.S. Mail. Extra shipping and processing charges apply for Alaska and Hawaii, and may take additional days to process. Shipping and processing charges are based on average/estimated weights and may vary from actual shipped weight. Call for detailed shipping and processing charges. The shipping, handling and processing charges are designed to compensate our company for services we provide that enable our customers the convenience of ordering from us and receiving delivery of our products, including but not limited to handling and processing your order, packing and shipping your purchase, and providing you customer service and support, as well as overhead costs associated with these services. Same day shipping: Web orders placed and credit approved by 4:00 p.m. (EST) weekdays for items in stock not requiring configuration for delivery to the contiguous U.S. will ordinarily ship the next day via FedEx 2Day Express. FedEx 2Day provides delivery by 5:00 p.m. the second business day in areas where available.   FedEx Standard Overnight provides delivery by 4:30 p.m. the next day and is available for an additional charge. Call 1-877-23-OOTBD for further information. For all orders where no shipping commitment is made, we expect to ship within 2 days of the order date. Shipping, Handling and processing charges may vary. Return Policy:
OOTBD prides itself on a tradition of outstanding customer care and support. Our devoted team of account representatives understands that our customers are the hallmark of our enduring partnerships. It is important for our customers to understand the standards that have been established within our industry regarding the terms and conditions of a sale.

If for some reason you wish to return or exchange your gift, you may ship it back to OOTBD P.O. Box 621044, Oviedo, FL 32762 within 30 days of purchase. As long as the item(s) is received undamaged and in condition to resell, the original sales price will be refunded. Original shipping charges are not refundable We highly recommend insurance when shipping an item back to us.

Custom Order Items: No returns or refunds will be made for items that are special ordered.

Damaged Shipments:
If your shipment arrives damaged: You must note the damage on the carrier’s delivery record in accordance with the carrier’s policy, save the merchandise in the original box and packing it arrived in, and notify OOTBD immediately to arrange for a carrier inspection and pick up of damaged merchandise. If you do not notify OOTBD of damaged goods within the first 7 days of arrival, the regular return policy will override any claim of damage.

Requirements qualifying product for Out of the Blue Delivered credit:
•   Product must have been purchased from OOTBD or www.bluedelivered.com website.
•   Product must be complete and free of any additional marks
•   Signed copy of the RA form and an OOTBD Return Authorization number must accompany shipment to Out of the Blue Delivered, Inc.
•   Copy of Proof of Purchase (POP) to consumer must accompany shipment to OOTBD.
•   Customer is responsible for freight charges (must be insured) when shipping product to OOTBD for return.
•   Any items received that are not covered by original RA will be returned at sender's expense.

Shipping Charges:
Original shipping charges are not refundable. Shipping charges on returned products are the responsibility of the customer. OOTBD will match the shipping method and pay for shipping charges on replacement or exchange products. We strongly recommend you fully insure your return shipment in case of loss or damage. All refused orders will be subject to a restocking fee. Shipping charges are not refundable. In addition, refused orders may be subject to additional shipping charges to cover the cost of returning the products to OOTBD.

Typographical, Photographical and Technical Errors:
Although we do our best to achieve 100% accuracy, occasionally errors and inaccuracies do occur. Should you encounter an error or inaccuracy, please inform us so it can be corrected. Products and packaging depicted may differ from stock available at the time of shipment. We reserve the right to substitute equivalent items. If an error is made and a product is listed at an erroneous price, OOTBD may, at its discretion, refuse or cancel any orders placed at the incorrect price. If an order has been confirmed and charged to your credit card at the incorrect price, OOTBD shall have the right to immediately issue a credit in the amount of the incorrect price.
Warranty Disclaimer and Limitations: OOTBD passes through to its customers all manufacturers’ warranties and guarantees that are provided for the products it sells which may be passed through to its customers. OOTBD makes no additional or independent warranties. To the full extent permissible by applicable law, OOTBD disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. OOTBD shall under no circumstances be liable for special, incidental, consequential (including lost profits or opportunities) or punitive damages, even if it has been advised of the possibility of such damages. The maximum liability of OOTBD for all damages shall be limited to an amount not to exceed the purchase price of the product. Likewise, OOTBD will not be liable for any damages of any kind arising from the use of its Web site, including, but not limited to direct, indirect, incidental, punitive and consequential damages. All merchandise is sold “as is”. Please check manufacturer packaging and materials for compatibility. OOTBD makes no warranty as to the performance of any merchandise sold. We are not responsible for network outages, system downtime, lost data, etc. This disclaimer by OOTBD in no way affects the terms of any applicable manufacturers’ warranties or guarantees. OOTBD will provide copies of such warranties and guarantees upon request emailing returns@bluedelivered.com   Certain state laws do not allow limitations on implied warranties or the exclusion or limitations of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you might additional rights and remedies that vary from state to state.
Disputes: You agree that any claims against OOTBD relating in any way to your purchases from OOTBD shall be submitted to confidential arbitration solely in Orlando, Florida, and you agree and submit to such jurisdiction and venue as exclusive and proper. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving and other party subject to this Agreement, whether through class arbitration proceedings or otherwise. In any such arbitration, the parties shall be responsible for their own costs, expenses and attorney’s fees. In the event that this arbitration provision is unenforceable, you further agree any litigation regarding this agreement or any transaction shall be brought in the state or federal courts located within “the Middle District of Florida, Orlando Division, United States of America. You hereby agree and submit to such jurisdiction and venue as exclusive and proper.

Governing Law:
This transaction shall be governed by and interpreted in accordance with the laws of the State of Florida, United States of America; provided, however, that any and all disputes hereunder shall be decided exclusively by litigation in state or federal courts located within “the Middle District of Florida, Orlando Division, United States of America.
Transactions between you and OOTBD, and any disputes arising between you and OOTBD, including but not limited to claims relating to the content of our catalogs and Web site, shall be governed by and constructed in accordance with the laws of “the Middle District of Florida, Orlando Division, without regard to the laws regarding conflicts of law. If any provision of this agreement and shall unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Title-Risk of loss:
Title to items being purchased passes from OOTBD to purchaser at the time of shipping. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. OOTBD will not incur any forwarding costs on shipments. OOTBD shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo or other acts or events outside the reasonable control of OOTBD.

Additional Information:
OOTBD policies are subject to change without notice. We do our best to ship all orders as rapidly and accurately as possible. However, OOTBD is not liable for late or delayed shipments or system failures. Title to items being purchased passes from OOTBD to purchaser at the time of shipping. If you purchase items for export, you must obtain from the Federal government certain export documentation. Specific Commercial Invoice will be provided by shipping carrier, and provided for customs clearance. Terms of OOTBD’s agreements with certain vendors on the web forbid us from exporting certain product. Some products are not available for sale to schools. All trademarks and registered trademarks are used to benefit of their respective owners.
Right of Offset: At any time what an amount is due OOTBD, OOTBD shall have the right, without prior notice, to set off and apply any amounts otherwise owed by OOTBD to you, to any amounts owed to OOTBD by you, in all cases.
